18 U.S.C. § 2257 RECORD-KEEPING COMPLIANCE STATEMENT
Effective Date: April 10, 2026
1. Purpose
This Statement describes the legal obligations imposed by federal law regarding visual depictions of actual sexually explicit conduct as defined under 18 U.S.C. § 2256(2):
- Obligations under 18 U.S.C. §§ 2257 and 2257A
- Responsibilities of content uploaders (Producers)
- Chattr’s limited role as a hosting service
2. Platform Role
Chattr operates as an interactive computer service provider that hosts, stores, and displays user-generated content. Chattr does not create or direct the production of user content.
To the extent permitted by law, Chattr relies on uploader certifications. Nothing in this Statement constitutes an admission of producer status by Chattr.
3. Contractual Certification Requirement
Before publishing sexually explicit content, each uploader must represent and warrant that:
- Every performer depicted was at least 18 years old at the time of production
- Government-issued ID was inspected and retained
- All required § 2257 records are maintained at a compliant location
- A Records Custodian has been designated
Chattr relies entirely on these representations for platform compliance.
4. Uploader / Producer Obligations
Uploaders are solely responsible for compliance. Failure to maintain records is a federal offense.
A. Age & Identity Verification
Inspecting and retaining a legible copy of a valid government-issued photo ID for each performer at the time of production.
B. Record Maintenance
Maintaining records at the address listed in the uploader’s location statement. Records must not be transmitted to Chattr unless requested via lawful process.
C. Records Custodian
Designating an individual capable of producing records during normal business hours for authorized inspectors.
D. Indemnification
Uploader must defend and hold harmless Chattr against any claim or enforcement action arising from deficient record-keeping.
5. Chattr Compliance Measures
Chattr may implement the following safety and compliance gates:
A. Identity Verification Gate
Upload capability may be restricted until uploader identity verification is completed.
B. Uploader ID Retention
Chattr may retain a copy of the uploader’s identification. Performer IDs are not routinely collected.
C. Notice & Enforcement
Upon evidence of non-compliance, Chattr may remove content, suspend accounts, and cooperate with investigations.
6. Exempt Material
Material that does not depict actual sexually explicit conduct or qualifies for regulatory exemption is outside § 2257 requirements. Determination of exemption status is the uploader’s responsibility.
7. Requests for Records
If a third party seeks § 2257 records relating to specific content:
- Contact the uploader directly via the Platform
- Email info@chattr.so with the content URL and username
Chattr does not possess producer records and cannot provide records it does not maintain.
8. Law Enforcement Cooperation
Chattr cooperates with duly authorized law enforcement. Upon lawful request, Chattr may provide account-level information and direct officials to the uploader’s Records Custodian.
9. Updates
This Statement may be updated to reflect changes in law. Continued use of the Platform constitutes acceptance of revisions.
